01Who we are

In short

These terms are an agreement between you and Axio, the company that makes Forge Cloud.

Forge Cloud ("Forge") is provided by Axio Technologies Limited, a company registered in [country] under number [registration number], with its registered office at [address] ("Axio", "we", "us").

These terms apply when you create a Forge account, use a Forge workspace, or buy a Forge plan or add-on. If you use Forge for a company, you confirm you may accept these terms for it, and "you" means that company.

By creating an account or using Forge you accept these terms and our Privacy Policy.

02Your account

In short

Forge is invite-only for now. Keep your sign-in safe; you are responsible for what happens in your workspace.

While Forge is invite-only, you need an invite link to create an account. Each person can invite a limited number of people each month. We record who invited whom so we can grow Forge safely.

You must give accurate details, keep your password and authenticator safe, and tell us promptly at security@forgecloud.cc if you think your account has been misused. Workspace owners decide who joins their workspace and what each member can do, and are responsible for their members' use of it.

You must be at least 18, or the age of majority where you live, to use Forge.

03Your servers and data

In short

Your servers and what runs on them are yours. Forge coordinates them; it does not own your data.

Forge deploys and manages software on servers you connect to it, through the Forge Agent you install. You rent those servers from your own provider and remain responsible for them, including their cost, their security settings outside Forge, and complying with your provider's terms.

Your code, your apps' data and your databases stay on your servers. You keep all rights in them. You give us only the permissions we need to run Forge for you, such as reading the repositories you connect, storing the settings and encrypted secrets you give us, and sending commands to the Agent.

You are responsible for the content you deploy, send or store with Forge, and for having the rights to it. Keep your own backups; Forge's backup features help but do not replace them.

04Plans and payment

In short

You pay a flat plan fee. Your server provider bills you separately. Billing problems never delete your apps.

New accounts start on the Free plan, or on a 14-day trial of Starter or Pro if they choose one, with no card needed. Free has no price and does not expire; its limits are shown on our pricing page, and it does not include email or new database backups. Free is meant for evaluation and personal or non-commercial projects, and we may ask you to move to a paid plan if a Free workspace is used to run a business.

When a trial ends, the workspace moves to Free. You then have seven days before Free's limits apply to the servers and members you already have: after that, only the first owner keeps access and only your oldest connected server can start new deployments. We do not delete your apps, data or members because of a plan change, and choosing a paid plan restores everything. You see the plan, amount, currency and any tax before you are charged.

Plans renew automatically each month or year until cancelled. Payments are processed by Paystack on Axio's behalf. If a renewal fails, you have a grace period to fix it; after that, new deployments and new resources are paused until billing is restored. Apps already running on your servers are never stopped or deleted because of a billing problem.

Extra servers, extra team members and email packs are prepaid for the period shown when you buy them and do not renew on their own. Unused prepaid emails expire 12 months after purchase.

Prices include tax where it applies. Except where the law requires otherwise, payments are not refundable. If you cancel, your plan stays active until the end of the period you have paid for. We give at least 30 days' notice of any price change, which applies from your next renewal.

05Acceptable use

In short

Don't use Forge to send spam, attack others, or break the law.

You must not use Forge to break the law or anyone's rights; to host malware or phishing; to attack, scan or overload other systems; to mine cryptocurrency on our infrastructure; or to get around Forge's limits, billing or security.

Email sent through Forge must be transactional or expected by its recipients. Forge applies sending levels and daily limits, and pauses sending automatically when bounce or spam-complaint rates are too high, to protect everyone who shares the sending network. We may review a paused workspace before sending resumes.

Deployment limits exist to catch mistakes such as a script deploying in a loop. Do not try to work around them.

06Our service and your feedback

In short

Forge itself stays ours. If you send us ideas, we may use them.

We own Forge, including the control plane, the Agent and our documentation. We give you a limited right to use them while your account is in good standing. The Agent is provided for use with Forge only.

If you send us feedback or suggestions, we may use them without owing you anything.

We may change Forge over time. We will tell you in advance about changes that materially reduce what your plan includes.

07Warranties and liability

In short

We work hard to keep Forge reliable, but it is provided as is, and our liability is limited.

Forge is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or suitable for a particular purpose.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost data, and our total liability for any claim is limited to the amount you paid Axio for Forge in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You agree to cover us for claims arising from your content, your apps or your breach of these terms.

08Suspension and ending the service

In short

You can leave any time. Your apps keep running on your server.

You can close your workspace or account at any time. Because your apps run on your servers, they keep running after you leave; you can uninstall the Forge Agent whenever you like.

We may suspend or close an account that breaks these terms, puts others at risk, or does not pay. Where we reasonably can, we warn you first and give you time to fix the problem and to export your settings.

Sections about payment owed, ownership, liability and governing law continue after the service ends.

09Changes, law and contact

In short

We tell you before these terms change. Questions go to support@forgecloud.cc.

We may update these terms. We will tell you about material changes at least 30 days before they take effect, by email or in the app. Continuing to use Forge after that means you accept the new terms.

These terms are governed by the laws of [governing law], and the courts of [jurisdiction] have jurisdiction, unless the law where you live gives you other rights.
